Terms of use for Kassensturz

1. Provider and scope

The provider of the app is NorthProfit UG (haftungsbeschränkt), Waldnieler Straße 28, 40549 Düsseldorf, Germany. The terms of the Apple App Store or Google Play also apply.

2. What the app does

Kassensturz adds up the quantities, rolls and bundles you enter for supported cash currencies, saves register counts and can calculate target vs. actual differences and suggest which float stays in the register and what goes to the bank. The accuracy depends on your entries; check suggestions before you take out or hand over cash.

The app is a counting and documentation tool. It doesn’t replace bookkeeping, a technical security device compliant with the German KassenSichV, or tax, legal or financial advice, and it doesn’t create a legally binding cash report.

3. Data, account and backup

Kassensturz works without an account; your data is then stored only on your device. You are responsible for creating a backup file or using account backup before deleting the app, changing devices or resetting. Without a backup we can’t restore data deleted locally.

From version 2.0 you can create an optional, free Kassensturz account; by creating it you accept these terms of use. The account is personal. Protect access to your email address or to your Apple or Google account. Account backup keeps the last three versions of your registers so that you can move them to a new device. It is a convenience feature and not an audit-proof archive; you also back up records you are required to keep yourself. We strive for high availability but can’t guarantee it at all times.

You can delete the account at any time in the app under “More” → “Account”, in the browser at Delete account or by email. The data on your device is kept. Details are in the privacy policy.

4. Scope without Pro, Pro and subscription

If you install Kassensturz from version 2.2.3, the first count including saving is free; further counts require Kassensturz Pro (use with a subscription). Saved counts stay readable even without Pro, and CSV export, the backup file and deleting stay free. If you used Kassensturz before version 2.2.3 (counts on the device or in your account backup), you keep the previous free scope: one register, including rolls and bundles, up to ten saved counts, all currencies and languages, the backup file and the account with account backup and transfer. CSV export is free for everyone from version 2.2.3. Kassensturz Pro unlocks multiple registers, unlimited saved counts, target vs. actual difference, PDF register receipt and monthly report as PDF, and float and deposit with deposit slip.

From version 2.2, Pro is available as a subscription with an annual or monthly term. New customers can try the annual subscription free for seven days; the trial is available once per store account. If you wish, the app reminds you two days before the trial ends. If you don’t cancel before the end of the trial, the paid annual subscription begins.

Subscriptions are billed by the respective store. They renew automatically for the chosen term unless you cancel, in the App Store at least 24 hours before the end of the current period. You cancel in the subscription settings of your Apple Account or in Google Play under “Subscriptions”. After cancelling, Pro stays active until the end of the paid period. Deleting the app or your Kassensturz account doesn’t end a subscription. Refunds are governed by the rules of the respective store.

The price that applies to you is shown by the respective store immediately before the purchase. Prices of running subscriptions change only according to the store’s rules; the store informs you beforehand and, where necessary, asks for your consent. You can restore purchases and subscriptions with the same store account on the same platform. If you are signed in with a Kassensturz account, Pro also applies on your other devices with this account, even between iPhone and Android.

Up to version 2.1, Pro was available as a one-time, non-consumable in-app purchase. Anyone who bought Pro that way keeps it permanently without a subscription and can restore the purchase at any time.

5. Permitted use

You may use the app as intended privately and within your own organisation. Not permitted are manipulation, circumventing purchase verification, signing in with other people’s accounts or addresses, abusive load on services and any use that violates the rights of third parties or applicable law.

6. Availability and changes

We maintain and improve the app and provide necessary security and compatibility updates. Features may change insofar as this is objectively necessary and reasonable. Statutory update and warranty rights remain unaffected.

7. Warranty and liability

The statutory warranty rights apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health and in cases of mandatory statutory liability. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typically foreseeable damage.

We accept no further liability for incorrect results due to incorrect or incomplete quantities or for backups not made. Mandatory consumer rights remain unaffected.

8. Termination

You can end your use at any time by deleting the app and, where applicable, your account. In the event of serious abuse we can block or delete an account; the data on your device is not affected. The handling of purchases and refunds is governed by law and the rules of the respective store.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it doesn’t deprive them of the mandatory protection of the country of their habitual residence. A place of jurisdiction in Düsseldorf applies only insofar as legally permitted.
