Terms of use for Zählerstand

1. Provider and scope

The provider of the app is NorthProfit UG (haftungsbeschränkt), Waldnieler Straße 28, 40549 Düsseldorf, Germany. These terms apply to the use of Zählerstand and the optional Zählerstand account. The terms of the Apple App Store or Google Play, through which you obtain the app or make a purchase, also apply.

2. What the app does

Zählerstand helps you record meter readings and tank levels and understand your usage. Exact differences are based on your readings. Projections, costs, monthly payment recommendations, unusual usage alerts and the Bill Radar are non-binding estimates based on your entries. Only the measurement and billing by your utility or metering point operator are binding.

Camera recognition is an input aid. You check and confirm every recognised reading yourself.

The app replaces neither a calibrated measurement nor energy, legal, tax or financial advice.

3. Data, backup and optional account

Without an account, your data stays only on your device. You are then responsible for creating and keeping a backup file before deleting the app, changing devices or resetting the device.

From version 2.0 you can create an optional account. The app then backs up your data end-to-end encrypted and syncs it between your devices.

• Keep the recovery key safe. We don’t know it and can’t replace it. If you lose the key and all devices, we can’t restore the backup either.
• Only confirm new devices if they show the same security code.
• If two devices change the same entry, the newer version applies; the app shows you the other one, and you can switch.
• The backup supplements your own precautions. You can still create backup files at any time.
• We delete accounts, including their backup, without a sign-in and without a used session for 24 months. The data on your devices is not affected.

4. Scope without Pro and Zählerstand Pro

From version 2.1.2 the following applies to new installations: setup and your first meter reading are free. After that you need Zählerstand Pro to use the app, as an annual subscription with a free trial month, if the store shows it to you, or as a monthly subscription. You can delete your data and your account at any time. If your trial or subscription ends without renewal, your meters and readings stay readable; export as CSV and backup file as well as deleting stay free, only new readings and new meters need Pro.

Anyone who used Zählerstand with their own data before version 2.1.2 keeps the previous free features: up to three meters with unlimited readings, usage and monthly projection including costs, history charts, a one-time reminder, the automatic reminder on your usual reading day and the “Next reading” widget, the camera scan, backup files and the account, backup and sync. CSV export is added from version 2.1.2. After Pro ends, the existing meters and data stay usable; further meters beyond three need Pro.

Zählerstand Pro extends the app, for example with unlimited meters, the Bill Radar with a monthly payment recommendation, unusual usage alerts, reports as PDF, comparisons and recurring reminders. The app shows the exact scope before the purchase.

Pro is available as an automatically renewing monthly or annual subscription. The term and the price that applies to you are shown in the respective store before the purchase. A free trial period applies only if the store shows it to you.

Purchases apply to the Apple or Google account you bought with and can be restored there. They aren’t tied to the Zählerstand account; a transfer between Apple and Google is not promised. Previously acquired unlocks and existing subscriptions keep their conditions.

5. Subscriptions

Payment is processed via your Apple or Google account. The chosen subscription renews automatically for the term shown unless you turn off automatic renewal in good time before it expires in the subscription management of the respective store. Management, cancellation, billing, refunds and price changes follow the rules of the store. Deleting the app or the account doesn’t end a subscription.

6. Permitted use

You may use the app as intended privately and within your own organisation. In particular, not permitted are manipulation, circumventing purchase verification, abusive or automated load on our services, creating accounts for third parties without their consent and any use that violates the rights of third parties or applicable law.

7. Availability and changes

We maintain and improve the app and provide necessary security and compatibility updates. We offer the account, backup and sync with reasonable care, without promising uninterrupted availability; the app remains fully usable without a connection. Features may change insofar as this is objectively necessary and reasonable for you. Statutory update and warranty rights remain unaffected.

8. Warranty and liability

The statutory warranty rights apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health and in cases of mandatory statutory liability. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typically foreseeable damage. Mandatory consumer rights remain unaffected.

We accept no further liability for incorrect results due to incorrect, incomplete or late entries, for unchecked camera recognitions, for decisions based solely on an estimate marked as such or for the loss of the backup after loss of the recovery key and all devices.

9. Termination

You can end your use at any time by deleting the app. You delete your account in the app under “More” → “Account” → “Delete account” or without the app at apps.northprofit.eu/zaehlerstand/en/delete-account/. You cancel a subscription exclusively in the subscription management of the respective store. Periods already paid for and refunds are governed by law and the store’s rules.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it doesn’t deprive them of the mandatory protection of the country of their habitual residence. An exclusive place of jurisdiction in Düsseldorf applies only insofar as this is legally permitted.
